Such an impunity leads to resignation and hinders any form of initiative towards democratisation as long as the omnipotence of the rulers is not eroded. This in turn means that the liquidation of some people entails the loss of many more people for the struggle for peace and democracy, as long as the perpetrators enjoy absolute power. We were with the people whom we are now accusing of human rights violations, but we could not and did not hinder them from committing atrocities, because we also had the "instinct for self preservation" and knew only too well that we had neither the possibility to protest nor the chance to make our protest known |

Commission Asks to Retract Corruption Charges, Press New Ones (August 1, 2002) In a sad but predictable continuation of the charade of a "trial" going on at the country's highest court, the Prosecutor representing the government filed to the court to retract the corruption charges under which the accused have been incarcerated for the last 14 months. In any other country in the world, indeed in any other court in the world (leave alone a country's final court), a filing by a prosecutor to withdraw charges would automatically result in the outright dismissal of the charges and the freedom of the accused (if they happen to be in detention as the case is here). Even as is reported here if the prosecutor submits his intention to file new charges, this would straightforwardly be treated by the court as a completely different matter altogether. Although the withdrawal of charges in itself is a vindication for the case of the accused-(who all along have been protesting their innocence)-one is, naturally, forced to wonder how much the country's values, norms and laws have to be abused and, as a direct result, how much the country and its people have to slide lower before an end is brought to all this damage. |

Supreme Court Adjourns Corruption Case Hearing for Three Days Daily Monitor, July 17, 2001 That the Supreme Court is completely under the domination of the Meles government and that it is thus engaged in a farcical charade of "dispensing justice" designed to fool the Ethiopian public at large and international observers in particular (but ends up in fooling itself only, one might add), can be seen from this report of a court proceeding back in July 2001. In that proceeding, the presiding judges had so much "trouble" and "agonized" so over a decision granting extension of the remand request by the police of yet another 14 days, that they decided to "confer" for three days before announcing their ruling. What do the honorable judges rule after three days? Not only do they grant the extension, they continued to regularly grant it well into October--until the police/prosecutor finally were able to cobble up an incredible document they called "charges". That these 'charges' were revised several times since, that the Supreme Court halted the proceedings well underway and ruled to go back to a 'pre-trial' stage, that the protestations of the defendants and their legal counsel fell on deaf ears, etc., are all matters of record.

'Justice delayed is justice denied!', goes a saying. How can one justify or explain away one solid decade of court proceedings? The trial of the Derg officials is a typical illustration of the ineptitude of the justice system in Ethiopia and the regard in which it is held by the "government"-a useful tool for implementing its policies, nothing more. A golden opportunity to establish the rule of law and to redress the pain and suffering of millions of victims of the horrendous crimes of the Derg has been lost forever.
